Terms of Use

These Terms of Use (“Terms”) are a binding agreement between you and Moment Labs Ltd (“Moment”, “we”, “us”) governing your use of the Moment app. By creating an account or using Moment, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use Moment. These Terms also serve as the end-user licence agreement (EULA) for the app.

1. Eligibility

You must be 18 or older, provide accurate account information (including a valid phone number), and be legally able to enter into this agreement. Moment is not available to anyone under 18.

2. The service

Moment lets you tell mutual friends you’re free or share a spontaneous “Moment”, and join theirs. It is real-time, ephemeral, and friends-only — there is no public feed. We may add, change, or discontinue features, and we may limit or suspend the service, at any time.

3. Your account

You are responsible for your account and everything that happens under it. Keep your phone number and device secure. Tell us at [email protected] if you suspect unauthorised use.

4. Your content

You own the content you post. You grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, and display your content to your mutual friends for the sole purpose of operating the app. This licence ends when the content expires or you delete it (except for copies we must retain to comply with the law or handle reports). You confirm you have the rights to what you post and that it doesn’t infringe anyone else’s rights.

5. Acceptable use — zero tolerance for objectionable content and abuse

There is zero tolerance for objectionable, abusive, harassing, hateful, threatening, illegal, or sexually explicit content, or for abusive behaviour toward other users. You agree not to post such content or to harass, threaten, or harm anyone.

6. Things you may not do

You agree not to: impersonate anyone; break the law; access or attempt to access other people’s data or accounts; scrape, reverse-engineer, or abuse the service or its infrastructure; interfere with its security; use it to contact people who haven’t chosen to be your mutual friend; or use it to arrange or facilitate anything illegal or harmful.

7. Meeting people in person — safety and assumption of risk

Moment can lead to meeting people in person. Your safety is your responsibility.

8. Account termination

You may delete your account and all your data at any time from Settings → Delete Account. We may suspend or terminate your account, without notice, if you violate these Terms or to protect users or the service.

9. Disclaimers

Moment is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, availability, or that content or people are accurate, safe, or appropriate. We do not guarantee the app will be uninterrupted or error-free.

10. Limitation of liability

To the maximum extent permitted by law, we (and our officers, employees, and suppliers) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, or for any harm arising from your interactions with other users or from meeting anyone in person. Our total liability for any claim relating to Moment will not exceed the greater of the amount you paid us in the 12 months before the claim or £50. Nothing in these Terms limits liability that cannot be limited by law.

11. Indemnity

You agree to indemnify and hold us harmless from any claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of Moment, your interactions with other users, or your breach of these Terms.

12. Third-party services

Moment relies on services from Google (Firebase) and Apple. Your use of the app is also subject to their terms, and we are not responsible for those services.

13. Apple App Store

These Terms are between you and Moment Labs Ltd, not Apple. Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support. If the app fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for any claims relating to the app (including product-liability, legal/regulatory, or consumer-protection claims). Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you are not in a country subject to a U.S. Government embargo or designated as “terrorist-supporting”, and are not on any U.S. prohibited-parties list.

14. Governing law and disputes

These Terms are governed by the laws of England and Wales, without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts of England and Wales for any dispute, except where mandatory local law gives you other rights.

15. Changes

We may update these Terms; material changes will be reflected here with a new date. Continued use after a change means you accept the updated Terms.

16. General

If any part of these Terms is unenforceable, the rest still applies. Our failure to enforce a term is not a waiver. You may not assign these Terms; we may assign them in connection with a merger or sale. These Terms and the Privacy Policy are the entire agreement between us regarding Moment.
